  1. Eligibility/Participation: The Classic Crush® Flavor Machine Instant Win Game (the “Instant Win Game”) is open only to legal US residents currently residing in the fifty (50) states and the District of Columbia, excluding Puerto Rico and Territories (“Eligibility Area”), who are twenty one (21) years of age or the minimum age of majority in their state of residence, whichever is older as of the date of their participation and Instant Win Game play and who possess a web-enabled mobile device. Employees directors and officers of Dr Pepper/Seven Up, Inc. (“Sponsor”), Upshot LLC, c/o Amp Activate ( “Administrator”), and any of their respective affiliates, franchisees, parents, subsidiary companies, and advertising and promotion agencies (collectively, the “Released Parties”), and members of the immediate families (spouses, parents, children, step children, siblings, step siblings, and their respective spouses, regardless of where they reside), and/or those living in the same household, of any of the foregoing, are not eligible. Employees (and their family members and household relatives) of any retailer where this promotion is marketed shall be ineligible to participate in this Promotion. The Instant Win Game is subject to all applicable federal, state, and local laws. By participating in the Promotion, you agree that: (1) you have read and understand the Official Rules; (2) you meet the Instant Win Game eligibility requirements as explained in the Official Rules; (3) you accept and agree to be bound by these Official Rules, to Sponsor's Conditions of Use located at https://www.keurigdrpepper.com/en/term-of-use; Legal Notices and Privacy Policy as published at https://www.keurig.com/content/privacy-policy;and (4) you unconditionally accept and agree to comply with and abide by the decisions of Sponsor and Administrator, whose decisions shall be final and binding in all respects.
  2. Instant Win Game Period:The Instant Win Game begins at approximately 9:00:00 am Eastern Time (“ET”) on 6/16/25 and ends approximately 11:59:59 pm ET on 9/14/25 (the “Instant Win Game Period”).
  3. How To Play:  During the Instant Win Game Period, either use your smart phone or other web-enabled device with data plan to scan the Instant Win Game quick response (“QR”) code featured on signs or promotional materials (the “Instant Win Game Microsite”) or visiting www.ClassicCrushArcade.com and following the onscreen prompts. You will be required to enable access to your device motion sensors, microphone, and camera, provide all required registration information, and confirm your eligibility and your agreement to these Official Rules prior to being able to play the game. Upon completing the registration process, you will have the opportunity to open the virtual game by clicking the button that says, play now (hereinafter a “Game Play” or “Play”). As you open the virtual game, you will be prompted to select a flavor-based character and begin play. Upon completion of the level or failure to complete the level, the user will be presented with an opportunity to spin the flavor machine. You must click on the spin button to see whether you’re an instant winner, subject to verification of eligibility and compliance with these Official Rules. If you are an instant winner, the message will indicate what you’ve won, subject to verification of eligibility and compliance with these Official Rules. You must click “Claim” to start the prize or offer claim process or receive instructions on how to claim your prize or offer. If you close the window prior to completing the prize or offer claim process, you may forfeit the prize or offer. If you are not a winner, the screen will indicate that you are not an instant winner, and you will be asked to try again tomorrow. All players who have completed Game Play will be entered for the chance to win a Grand Prize (“Grand Prize”) in a random draw after the Instant Win Game Period. For the avoidance of doubt, you have not “Played” the game until you have spun the flavor machine wheel and revealed a winning or non-winning message. Each participant, regardless of email address used, may Play one (1) time per day during the Instant Win Game Period unless you have already won a prize or offer. Each time a player successfully completes Game Play they will receive one (1) entry into the drawing for the Grand Prize. For the purposes of this Instant Win Game, a “day” is a calendar day, beginning at 12:00:00 a.m. ET (except for the first day, which begins at 9:00:00 am ET) and ending at 11:59:59 p.m. ET. Multiple entrants are not permitted to share the same email address or account. Any attempt by any entrant to obtain more than the stated number of Plays, by using multiple/different email addresses, identities, registrations, accounts, logins, or any other methods will void that entrant’s Plays and that entrant may be disqualified. Use of any automated, programmed, robotic or similar system to participate is prohibited and may result in disqualification. Those who do not follow all the instructions, provide the required information, or abide by these Official Rules or other instructions of Sponsor may be disqualified.
  4. INSTANT WIN PRIZE OR OFFER WINNER DETERMINATION: Two thousand one hundred and sixty (2,160) random, computer-generated winning times will be generated during the Instant Win Game Period. Odds of winning an Instant Win Game prize or offer depend on the actual number of eligible Game Plays received and the timing of such Game Plays. If you are the player to Play the Instant Win Game exactly at, or the first player to Play immediately after one (1) of the predetermined randomly generated winning times, you will be a potential Instant Win Game Prize or Offer Winner (defined below). In these winning moments, a winning message with congratulatory copy and a claim prize or offer button will appear, which leads to a prize or offer fulfillment page. If you are not a potential Instant Win Game Prize or Offer Winner, a non-winning message will appear, prompting you to play again the next calendar day throughout the Instant Win Game Period.
  5. INSTANT WIN PRIZES AND OFFERS/APPROXIMATE RETAIL VALUE (“ARV”): Instant Win Game prizes and offers are detailed in the chart below. Ten (10) instant win game winners (“Prize Winners”) will receive a gaming console (ARV: $250). Ten (10) instant win game winners (“Prize Winners”) will receive a Speaker Cooler (ARV: $150). Twenty five (25) instant win game winners (“Prize Winners”) will receive a Polaroid Film Camera (ARV: $100). Fifteen (15) instant win game winners (“Prize Winners”) will receive a Modern Boombox (ARV: $75). One hundred (100) instant win game winners (“Prize Winners”) will receive a Blue Lava Lamp (ARV: $35). Two hundred and fifty (250) instant win game winners (“Prize Winners”) will receive a $25 Food Delivery Gift Card (ARV: $25). Two hundred and fifty (250) instant win game winners (“Prize Winners”) will receive a $25 E-Gift Card to a Gaming Retailer (ARV: $25). One thousand five hundred (1,500) offer winners (“Offer Winners”) will receive a beverage coupon as further described in the below chart. On or about two (2) business days after the Instant Win Game Period had ended, Administrator, an independent judging agency, shall perform a prize drawing, from among all Entries received, and select one (1) Grand Prize Winner (“Grand Prize Winner”). Once confirmed, as detailed below, the Grand Prize Winner will receive an “80’s Arcade Trip” including economy airfare for up to four, a five-night stay at an “80’s Arcade inspired Airbnb” accommodation and a one thousand five-hundred-dollar ($1,500) stipend for transportation and food. The Total ARV of Grand Prize: ($7,500). Grand Prize will be fulfilled in 6-8 weeks following completion of the verification process. Instant Win Game prizes and offers are not transferable, substitutable, or redeemable for cash by winners. Sponsor reserves the right, in its sole discretion, to substitute a prize or offer (or a portion thereof) for a prize or offer of comparable or equal value. All federal, state, and local taxes, if any, on a prize or offer, are solely the responsibility of the applicable winner. Unclaimed Instant Win Game prizes or offers will be awarded in a Second Chance Random Drawing (see Rule #7 below for details). All prize and offer details are at Sponsor’s sole discretion. There is a limit of one (1) Instant Win Game prize or offer per person for the entire Instant Win Game Period. Total ARV of all prizes available to be awarded: $31,125.

    If, due to an error of any kind, there are more valid Instant Win Game prize or offer claims received for any prize or offer level than the number set forth in these Official Rules, Sponsor may conduct a random drawing from among all valid prize or offer claims received for such prize or offer to award the number stated in these Official Rules. In no event will more than the stated number of prizes or offers listed in these Official Rules be awarded. ARV is as of date of printing of these Official Rules. The difference in value of prize or offer as stated herein and value at time of prize or offer notification, if any, will not be awarded. Winner acknowledges that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize or offer, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any warranties and/or guarantees on a prize or offer (if any) are subject to the respective manufacturers’ terms therefore, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee. Coupon offer and Gift Card subject to terms and conditions set thereon.

  6. INSTANT WIN PRIZE OR OFFER WINNER NOTIFICATION/VERIFICATION: Potential Grand Prize winner will be required to sign and return a Declaration of Eligibility and Liability Release and will be required to complete any applicable tax forms, and except where prohibited, Publicity Release (“Declaration”) within forty-eight (48) hours of notification. If potential Grand Prize winner fails to return the completed Declaration within forty-eight (48) hours of notification attempt, or if notification is returned as undeliverable, or if potential Grand Prize winner is deemed ineligible or otherwise not in compliance with these Official Rules, then potential Grand Prize winner will forfeit the prize and it will be awarded in the Second Chance Random Drawing.

    The potential E-Gift Card Instant Win Prize Winners may be required to confirm their addresses (physical and/or electronic) to claim their prize. If a potential Instant Win Game Prize or Offer Winner cannot be contacted via the email provided upon Game Play, fails to confirm necessary information within the time period required, or if a prize or offer notification is returned as undeliverable, or a potential E-Gift Card Instant Win Prize Winner is deemed ineligible or otherwise not in compliance with these Official Rules, then potential E-Gift Card Instant Win Prize Winner will forfeit the prize and the prize will go unawarded.

    A participant is not an official Instant Win Game Prize or Offer Winner, even if a winning message should so indicate, unless and until participant’s eligibility has been confirmed and verification is complete, in Sponsor’s sole discretion. Sponsor will not accept screen shots or other evidence of winning in lieu of its validation process. All winners are subject to verification of eligibility. All material submitted becomes the sole property of the Sponsor and will not be returned. Use of automated Game Play devices or programs is prohibited. Sponsor is not responsible for any change of email address, mailing address and/or telephone number of entrants.

  7. SECOND CHANCE DRAWING: Any unclaimed or unawarded Prizes or offers returned as undeliverable will be awarded in a second chance random drawing (“Second Chance Random Drawing”), conducted by the Administrator on or about October 1, 2025, from among all eligible non-winning Game Plays received throughout the Instant Win Game Period. Odds of winning a Prize of offer in the Second Chance Random Drawing depend upon the number of eligible non-winning Game Plays received during the Instant Win Game Period and number of unclaimed/unawarded Prizes or offers (if any). Second Chance Prize of Offer Winners will be required to sign and return a Declaration (as defined above) along with any applicable tax forms within forty-eight (48) hours of notification or prize or offer may be forfeited and awarded to an alternate winner. Return of any Second Chance Game prize or offer as undeliverable or declining a Second Chance Game prize or offer for any reason, will result in disqualification without further notice and selection of an alternate Second Chance Game Prize or Offer Winner, in a random drawing from among all remaining eligible non-winning Game Plays.
  8. GENERAL CONDITIONS: Should the Instant Win Game (or any portion thereof) be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Plays or prize or offer claims, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Instant Win Game and, if terminated, at its discretion, award all Instant Win Game prizes or offers claimed properly prior to the expiration date and any unclaimed Grand Prizes from all eligible, non-suspect, non-winning Plays received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning Play will be declared based upon the authorized account holder of the e-mail address submitted at time of Play and they must comply with these Official Rules. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE INVOLVED IN THIS INSTANT WIN GAME OR UNDERMINE THE LEGITIMATE OPERATION OF THE INSTANT WIN GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
  9. LIMITATIONS OF LIABILITY: Each entrant hereby agrees to release, indemnify, and hold harmless the Released Parties from any claims, actions, damages, losses, or injury of any kind including but not limited to personal injury or death, resulting from participating in the Instant Win Game or from acceptance, use or misuse of a prize or offer awarded or participation in any prize or offer related activity. This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, special, exemplary, punitive, incidental, indirect, or consequential damages; loss of data, income, or profit; loss or damage to property and claims of third parties. Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled Game Plays, prize or offer claims, emails or other communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider, website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Instant Win Game, including, without limitation, errors or difficulties which may occur in connection with the administration of the Instant Win Game, the processing of Game Plays or prize or offers claims, the announcement of the prizes or offers or in any Instant Win Game-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by users, tampering, hacking, or by any equipment or programming associated with or utilized in the Instant Win Game. Released Parties are not responsible for injury or damage to participants' or to any other person's computer or other device related to or resulting from participating in the Instant Win Game.
  10. Governing Law/Venue: THE INSTANT WIN GAME IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF TEXAS, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN COLLIN COUNTY, TEXAS. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN TEXAS. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN COLLIN COUNTY, TEXAS. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL, OUT-OF-POCKET DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, INDIRECT, SPECIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. ENTRANTS AGREE THAT ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS PROMOTION SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.
